Herman Nilica, 23, met a 19-year-old man in a parking garage to seek revenge for a female friend.

It ended with Herman Nilica being shot to death.

Now the 19-year-old is acquitted in the Court of Appeal, which considers that it was an emergency situation.

Aftonbladet has previously reported on the fate of Herman Nilica. 23-year-old Herman was deeply addicted to oxycontin, and was shot to death when he arranged to meet a 19-year-old man in central Karlshamn.

The 19-year-old was sentenced in the district court to 15 years in prison for murder.

The verdict was appealed to the Court of Appeal, which today acquitted the 19-year-old of the murder charge. A new analysis of the 19-year-old’s protective vest supports the thesis that Herman Nilica first attacked with a machete.

Couldn’t run from there

The 19-year-old also lacked the opportunity to call for help, and due to a physical disability had difficulty running away, according to the Court of Appeal.

They also find it clear that the 19-year-old was attacked by one more person, in addition to Herman.

– The 19-year-old has been subjected to a very serious attack, which included violence with life-threatening consequences. It is clear that he felt exposed to life-threatening violence, says Court of Appeal advisor Sofia Olsson in a press release.

That Herman Nilica was shot to death is therefore considered to be within the scope of the emergency protection provision.

“Even if the man used more violence than he had the right to, he was in such a tight situation that he could hardly come to his senses,” writes the Court of Appeal for Skåne and Blekinge.

Had shaved a woman’s hair

On the other hand, the 19-year-old is convicted of aggravated weapons offences, as well as aggravated unlawful threats and unlawful coercion against a 20-year-old woman.

According to the prosecutor, the 19-year-old had shaved off the hair of this woman, whom Herman knew, a few days earlier. The shaving is said to have been a punishment for an unpaid debt, and the woman is also said to have been threatened with a gun.

– And that’s the sort of thing that Herman gets started on. Then he will defend her after all, the mother Maria Nilica has told.

The 19-year-old is sentenced to prison for three years and four months. He must also pay damages of SEK 35,000 to the woman. On the other hand, nothing for Herman Nilica’s relatives, because the Court of Appeal acquits him of the charge of murder.
